  • Driving under the influence (Transportation Code Section 21-902): It is illegal to drive with a blood alcohol concentration of .08 percent or more in Maryland. Drivers determined to be under the influence of alcohol may be held accountable for their actions by criminal prosecution. However, that proceeding will not result in financial compensation for the injured victims. To receive compensation for a crash, the injured victim will have to hold the intoxicated driver civilly liable with a personal injury claim.
  • Speeding (21.801): Maryland has established speed restrictions. For example, drivers are limited to 30 mph in business districts and 35 mph in residential neighborhoods. Drivers that exceed the speed limit or drive at an unsafe rate or speed, given the traffic and weather conditions, could be held liable for accidents they cause.
  • Dangerous left hand turn (21-402(a)): Drivers that are taking a left hand turn, “shall yield the right-of-way to any other vehicle that is approaching from the opposite direction and is in the intersection or so near to it as to be an immediate danger.”
  • Illegal u-turn (21-402(b)): “If the driver of a vehicle intends to turn to go in the opposite direction, the driver shall yield the right-of-way to any approaching vehicle that is so near as to be an immediate danger.”
  • Reckless and negligent driving (21-901.1): Maryland defines reckless driving as driving with a “willful disregard for the safety of persons or property.” Negligent driving is defined as driving in an “imprudent manner that endangers any property or the life or person of any individual.”

Other dangerous forms of driving that can lead to a car crash include: running a red light, driving fatigued and distracted driving. An injured victim does not have to prove that the other driver violated the law, but it will be necessary to prove that the other driver was responsible for the crash.
