Maryland Anesthesia Error Attorneys

When an Anesthesiologist Harms You, We’re Here to Help

The use of anesthesia is common but highly complicated. One mistake could result in serious complications and injury to the patient, including death, paralysis, and brain injury.

If you or a loved one has suffered injury because of an anesthesia error, you may have the right to hold the anesthesiologist, certified registered nurse anesthetist (CRNA), or other medical provider responsible.

At Alpert Schreyer, LLC, our Maryland and DC anesthesia error attorneys are here to guide you through the legal process and maximize your compensation. We can handle all the paperwork and complexities on your behalf, cutting through legal red tape to bring you justice.

Medical negligence cases are already an uphill battle, especially when you are focused on healing from your injuries and putting your life back together. When anesthesia is involved, that hill only gets steeper. Medical professionals, insurance companies, and defense attorneys gladly take advantage of the average person’s lack of medical expertise. Their goal, after all, is to keep as much money as they can in their pocket. You need a trained legal professional to fight on your side, in your best interests. Alpert Schreyer, LLC is here to do just that.

What Is Anesthesia Malpractice?

“Anesthesia malpractice” is the legal term for when a medical provider makes preventable, unexpected mistakes in relation to the use of anesthesia.

Since anesthesia malpractice is a type of medical malpractice, or medical negligence, those injured must prove that the at-fault medical provider owed them a duty of care. This duty is created by an established nurse- or doctor-patient relationship. Any sort of negligent act that goes against medical industry standards is considered a violation of this duty and, therefore, gives the injured patient the right to compensation.

A few examples of anesthesia malpractice include the following:

  • Pre-surgery errors, such as failing to obtain informed consent from the patient, to warn a patient of the risks of anesthesia, and to consider a patient’s medical history.
  • Administration errors, such as giving the patient too little, too much, or the wrong type of anesthesia. This may also include improper intubation (the insertion of a breathing tube).
  • Failure to monitor errors, such as failing to monitor the patient for complications and distress, as well as failing to promptly address any complications that occur.
  • Communication errors, such as a lack of communication between surgeons, anesthesiologists, nurses, and any other medical professionals in the room at the time. Language barriers can also be an issue.
  • Post-surgery errors, such as discharging the patient too early and while they are still very much under the effects of anesthesia.

Each of these anesthesia errors can lead to a host of complications and injuries. Depending on the type—general anesthesia, regional anesthesia, local anesthesia, or IV/monitored sedation—the patient may not know anything went wrong until days, weeks, or months later. Importantly, anesthesia errors can occur during procedures in the hospital, or at out-patient surgical centers.

When Anesthesia Errors Cause Injury

Complications from anesthesia errors often result in the following injuries:

Please note: Any type of anesthesia can be misused by a negligent medical provider. For example, some patients are harmed by anesthesia errors while having their wisdom teeth pulled. Others may be hurt by the incorrect use of an epidural during labor and delivery.

At Alpert Schreyer, LLC, our lawyers often receive calls from patients unsure whether they have been harmed by anesthesia malpractice. Sadly, many medical providers misrepresent any error on their part as something that was unavoidable. If you were injured but are unsure about whether negligence played a role, we can investigate your case to find the answer.
