Who Can File a Wrongful Death Case?
Although many people may be devastated after a fatal accident, state law grants the right to take legal action only to those directly affected. This is because some people are closer and/or more dependent on that person, such as a surviving spouse or child.
Maryland’s wrongful death laws mandate the following:
- The decedent’s surviving spouse, child, and parent(s) are prioritized as primary beneficiaries. This means they have “first priority” when it comes to filing a wrongful death claim.
- If all primary beneficiaries are no longer alive upon the victim’s death, the next group of people, secondary beneficiaries, may pursue compensation. Generally, others who were “substantially dependent” on the decedent AND related to them by blood or marriage fall into this category.
Unfortunately, state law does not allow relatives who were not dependent on the decedent to file a claim. Only primary and secondary beneficiaries are eligible to do so.
